Terms and Conditions
Last updated: June 2026.
1. Purpose and acceptance
These Terms and Conditions govern access to and use of the CARSGEST rent-a-car management software (the "Service"), provided on a subscription basis. By creating an account, subscribing or using the Service, you accept these Terms in full. If you do not agree, you must not use the Service.
2. Definitions
- CARSGEST ("we"): the provider of the Service.
- Customer ("you"): the individual or company that subscribes to the Service.
- Licence: the right to use the software, tied to a domain.
- Account: the record granting access to the customer area and management panel.
3. Account and registration
To subscribe you must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.
4. Licence to use
We grant you a non-exclusive, non-transferable, revocable licence to install and use CARSGEST on the domain tied to your subscription, while it remains active and in good standing. The licence is validated periodically and is subject to the plan limits (e.g. number of vehicles and users). Reselling, sublicensing, copying or reverse-engineering the software is prohibited, except as permitted by law.
5. Subscriptions and payments
The terms for plans, billing, renewal, cancellation and refunds are set out in the Subscriptions and Payments Policy, which forms an integral part of these Terms.
6. Customer obligations
You undertake to use the Service lawfully, not to compromise the security or integrity of the system, and to comply with applicable law — including the protection of your own customers’ personal data (see the Data Processing Agreement).
7. Intellectual property
The software, brand, source code and content of CARSGEST are the property of the provider and protected by intellectual property rights. The subscription transfers no ownership. The data you enter into the system remains yours.
8. Availability and support
We strive to keep the Service available and secure; interruptions may occur for maintenance or causes beyond our control. Support is provided by email and tickets, prioritised according to the subscribed plan.
9. Limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, we are not liable for lost profits, data loss or indirect damages. Our total liability is limited to the amount paid for the subscription in the 12 months preceding the event.
10. Suspension and termination
We may suspend or terminate access in the event of breach of these Terms or non-payment. You may cancel your subscription at any time, under the Subscriptions and Payments Policy.
11. Changes to the Terms
We may update these Terms. Material changes will be communicated, and continued use after they take effect constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by Portuguese law. Disputes are subject to the courts of the provider’s registered seat, without prejudice to mandatory consumer-protection rules.
